Requirements for Access to Family Allowance

A person must satisfy the following criteria to be eligible for the Family Allowance payment:

  • Be in charge of a kid under the age of 18’s care and education.
  • If the child is at a youth center, the parent must live with the child or pay the center’s necessary contribution.
  • Live in Québec (as defined by the Taxation Act of Québec).
  • One of the following statuses applies to the recipient or his or her spouse:

1. A citizen of Canada.

2. Long-term resident.

3. A temporary resident who has lived in Canada for the last 18 months.

4. A person who is protected.

The payment of Family Allowance is not available to:

  • The foster family of the youngster.
  • Revenue Québec has exempted a person from paying taxes.
  • A person who is waiting to be designated as a protected person (refugee claimant).
  • A child who is married or in a de facto (common law) relationship with his or her spouse was entitled to a transfer of assets from one spouse to the other.

Who is eligible to receive Family Allowance payments?

To decide which spouse would receive the family’s Family Allowance payments, certain rules are used.

In situations of joint custody, the Taxation Act mandates that Family Allowance payments be given to both parents at the same time and on the payment frequency specified by each parent (quarterly or monthly).

How do you get paid?

For newborns, a simplified method has been developed.

Parents do not have to apply for Family Allowance payments when their kid is born in Quebec. When a child’s birth is reported to the Director of Civil Registry, that child will be immediately registered.

Other circumstances

If you meet the following criteria, you must make an application for Family Allowance:

  1. You choose to adopt a child.
  2. You are a newcomer to Québec or have recently moved here.
  3. Your youngster arrives in Québec or returns there.
  4. Your kid was born outside of Québec, yet you live in the province.
  5. You are granted parental rights to a child.
  6. You are granted joint custody of a child.
  7. Following the dissolution of your marriage, you maintain custody of a kid and were not previously getting Family Allowance payments in your name.

Payment of the First Family Allowance

After receiving the declaration of birth from the Director of Civil Registry, they will issue the first Family Allowance payment within 40 days.

If all of the qualifying conditions are satisfied, they can pay Family Allowance retroactively for 11 months from the day an application is submitted.

Even if they have no income, the beneficiary and his or her spouse must file an income tax return in order to get Family Allowance.

Amounts and payment of Family Allowance

The amount of the Family Allowance payments varies from one family to another. The calculation takes into account:

  1. The number of dependent children under age 18 who live with you.
  2. The number of children in shared custody.
  3. The family situation (single-parent or two-parent).

Methods of Payment of Family Allowance

Only one individual in the household can get Family Allowance. In the case of shared custody, the sum is divided and paid to both parents on the basis of the payment frequency selected by each parent (quarterly or monthly).

The Family Allowance payment is made on the first working day of each quarter, four times a year:

  • In July, August, and September for the months of July, August, and September.
  • In October, November, and December for the months of October, November, and December.
  • For the months of January, February, and March.
  • In April for the months of April, May, and June.

They are due money if it is owing to them

A change in a person’s family circumstances might have an impact on the amounts to which they are entitled. If you get an overpayment, you must repay it.

The following formula calculates the amount deducted from payments to settle a debt.

If the yearly family income is less than or equivalent to $35 000, you will get half of the payment. It’s worth noting that they can withhold more than half of a payment if the remaining balance isn’t enough to pay off the obligation. They can withhold more than half of the payment in some circumstances, even though the family’s income is less than or equal to $35,000.

If the family’s yearly income is greater than $35 000, they will get 100% of the payout.

If you find yourself in one of these circumstances, you may be eligible for Family Allowance:

1. Adoption and birth outside of Québec:

  • You choose to adopt a child.
  • Your kid was born outside of Québec, but he or she now lives with you in the province.

2. Child custody and divorce:

  • You are not getting Family Allowance payments in your name and have at least 40% custody time with the kid if you meet the following criteria:
  1. There has been a split.
  2. The death of a parent.
  3. There has been a change in custody.

3. A newcomer:

  • You become a Québec resident.
  • Your child has returned to the province of Québec.

Quebec Family Allowance Application

You do not need to file an application if your kid was born in Québec. The Director of the Civil Registry will automatically enroll you in the family allowance upon receipt of your newborn’s birth certificate.
